It aims to achieve a balance between the rights of both parties and ensure a stable and fair work environment.<\/p>\n<p>Among the important legal concepts included in the Labor Law is the concept of prescription, a legal principle that results in the lapse of the right to file a lawsuit after a specific period of time determined by the law. Prescription is a means of achieving legal stability and preventing disputes from remaining open indefinitely.<\/p>\n<h2>The Concept of Prescription in the Labor Law<\/h2>\n<p>In the Saudi Labor Law, prescription means the lapse of the right to file a labor claim before the competent judicial authorities if it is not claimed within a specific period determined by the law.<\/p>\n<p>Prescription does not mean the loss of the right itself in substance, but rather the forfeiture of the right to pursue legal action. This principle is based on practical and legal considerations, the most important of which are the stability of transactions and the protection of parties from late claims that become difficult to prove over time.<\/p>\n<h2>The Legal Basis for Prescription in the Saudi Labor Law<\/h2>\n<p>The Saudi Labor Law explicitly stipulates the principle of prescription. Article (234) of the law states:<\/p>\n<p>\u201cNo claim relating to a claim for any of the rights stipulated in this law or arising from an employment contract shall be heard after the lapse of twelve months from the date of termination of the employment relationship.\u201d<\/p>\n<p>It is understood from this text that the Saudi legislator has set a specific prescription period for labor claims, which is one year starting from the date of termination of the employment relationship, whether due to resignation, dismissal, expiry of the contract, or any other reason for termination.<\/p>\n<h2>Scope of Application of the Statute of Limitations<\/h2>\n<p>The statute of limitations in the Saudi Labor Law covers all labor claims arising from the employment contract or the application of the provisions of the law, such as:<\/p>\n<ul>\n<li>Claims for unpaid wages.<\/li>\n<li>Claims for end-of-service benefits.<\/li>\n<li>Claims for compensation for wrongful termination.<\/li>\n<li>Claims for accrued vacation days.<\/li>\n<li>Claims for overtime pay.<\/li>\n<\/ul>\n<p>It should be noted that the scope of the statute of limitations is broad, encompassing most labor rights, unless a specific provision exempts a particular right from the statute of limitations.<\/p>\n<h2>Start of the Statute of Limitations<\/h2>\n<p>According to the regulations, the statute of limitations begins from the date of termination of the employment relationship, not from the date the right arose or was breached.<\/p>\n<p>This distinction is important because it gives the employee sufficient time to gather their documents and consider claiming their rights after the termination of the contractual relationship, without being restricted by the date of the breach itself.<\/p>\n<h2>The rationale behind the statute of limitations:<\/h2>\n<p>The statute of limitations in the Saudi labor law was introduced to achieve several objectives, most notably:<\/p>\n<p>Achieving legal stability: by preventing labor disputes from remaining unresolved for extended periods.<\/p>\n<ul>\n<li>Protecting the judiciary from the accumulation of old cases that are difficult to adjudicate due to lost evidence or changed circumstances.<\/li>\n<li>Encouraging parties to proactively claim their rights in a timely manner.<\/li>\n<li>Achieving a balance between the interests of the worker and the employer, ensuring that neither party is subject to unexpectedly delayed claims.<\/li>\n<\/ul>\n<h2>Statute of Limitations and Public Order<\/h2>\n<p>The statute of limitations in the Saudi labor system is considered a matter of public order, given its direct impact on achieving stability in labor transactions and regulating the relationship between workers and employers.<\/p>\n<p>When the legislator set a time limit for hearing labor claims, its aim was to protect the public interest and prevent the continuation of disputes for extended periods, which could lead to disruption in the work environment and difficulty in proving rights. Accordingly, labor courts are obligated to apply the provisions of the statute of limitations whenever its conditions are met, even if the parties have not explicitly agreed to this.<\/p>\n<p>Considering the statute of limitations as a matter of public order means that it is impermissible to agree to deviate from it. Therefore, it is not permissible to agree to extend or shorten the statute of limitations period, nor is it permissible to include a clause in the employment contract that deprives the worker of their right to file a claim within the prescribed legal timeframe. Any agreement that violates the provisions of the statute of limitations is considered null and void, in order to preserve justice and protect the weaker party in the employment relationship, namely the worker, and in accordance with the objectives of the Saudi labor system in achieving balance and stability in the labor market.<\/p>\n<h2>The Difference Between Prescription and Extinction of a Right<\/h2>\n<p>The fundamental difference between prescription and extinction of a right lies in their respective effects on the possibility of a legal claim.<\/p>\n<p>Prescription prevents a lawsuit from being heard in court if it is not filed within the prescribed period, but it does not extinguish the right itself substantively. That is, the right remains valid but cannot be legally claimed after the expiration of the period.<\/p>\n<p>Extinction of a right, on the other hand, leads to its permanent demise, ending the right to claim it, whether legally or practically, and the party can no longer claim it in any way. This highlights the role of prescription as a mechanism to protect legal stability without prejudice to the substantive rights of the parties.<\/p>\n<h2>The Effect of the Statute of Limitations on Labor Claims<\/h2>\n<p>If a worker files their claim after the statute of limitations has expired, the employer may raise the objection that the claim is inadmissible due to the statute of limitations.<\/p>\n<p>The labor court, once it is established that the statutory period has expired, is obligated to rule the claim inadmissible, without addressing the merits of the dispute. The statute of limitations is considered a procedural objection that must be raised in a timely manner.<\/p>\n<h2>Exceptions to the Statute of Limitations<\/h2>\n<p>Despite the clarity of the legal text, there may be some cases in which the statute of limitations does not apply, such as:<\/p>\n<p>If a legal or regulatory impediment prevented the filing of the lawsuit within the specified period.<\/p>\n<p>If the employer explicitly acknowledges the right after the termination of the employment relationship, which may interrupt the statute of limitations and restart its running.<\/p>\n<p>However, these cases are assessed by the court according to the specific facts of each case.<\/p>\n<h2>Conclusion<\/h2>\n<p>It is clear from the foregoing that the statute of limitations in the Saudi labor system represents one of the important pillars for achieving justice and stability in labor relations.<\/p>\n<p>The legislator has been careful to specify a clear timeframe for claiming labor rights, thus ensuring the protection of the interests of both the worker and the employer.
